Our team is led by acclaimed complex trust, probate litigation and fiduciary law expert Mary C. Burdette. Her accomplishments and extensive achievements are detailed in her biography.

As the director of our group’s fiduciary litigation department, Mary brings her sophisticated trust and estate litigation skills and expertise to each case we accept that involves a dispute.

Mary has served as a Fellow of the American College of Trust & Estate Counsel (“ACTEC”) since 2008 and has been Board Certified by the Texas Board of Legal Specialization in Estate Planning & Probate law since 1996.

ESTATE LITIGATION

Estate litigation typically includes matters such as will contests, disputes over the meaning of various will provisions, removal of an executor or administrator, and heirship issues. These disputes occur after a person has passed away.

GUARDIANSHIP

Guardianships often involve adults who have become incapacitated for various reasons, and can involve minors with or without disabilities. Guardianships can provide assurances to family members that their child, spouse, or parent will be cared for and protected. Guardianships can become contests when a proposed ward disputes the need for a guardianship or there is a dispute over who should serve as a guardian of the person or estate.

WILL CONTESTS

A person’s last will and testament is one of the most important documents a person signs in their entire life. It is his or her last statement on earth and speaks for them post-death. However, in certain situations, will contests may arise.

PROBATE & ESTATE ADMINISTRATION

When a person dies, with or without a will, the “Estate” may require administration through a probate court. Our experienced probate attorneys can guide you through the entire process.

TRUST LITIGATION

Trust litigation typically involves disputes arising between trustees and beneficiaries of a trust and can occur before or after a Grantor (the creator of a Trust) passes away. Types of cases include trust contests, trust terminations, breach of fiduciary duty, and removal of a trustee(s), among others.
